Rule requires all local planning, taxing and zoning authority to be
granted by the General Assembly. If a locality doesn't have explicit
permission to do something, it must get the approval of the General
Assembly. Some examples of initiatives that would require the approval
of the General Assembly are: local income taxes (in most jurisdictions
including Charlottesville-Albemarle) and impact fees for developers.
Some argue that the Dillon Rule ties the hands of local government and
makes it difficult to address sprawl. Others argue that localities fail
to use the tools available to them, such as comprehensive planning, to
adequately address growth. By one estimate, 45 states employ a form of
home rule, while 5 states still adhere to the Dillon Rule. |
